Please read These TERMS OF SERVICE carefully before using this website or PURCHASING OUR PRODUCTS.

These terms apply to your use of this website and all of the sites and services owned or operated by TJT Coaching including but not limited to: www.tjtcoaching.com, and www.traceyjoanthomas.com. These terms also apply when you purchase any of our products or services on this Site including our group and individual coaching programs and our e-learning courses, e-books and other products (collectively, our “Products”). By accessing or using the Sites or purchasing a Product, you agree to be bound by and to follow these terms.

We reserve the right to modify these terms at any time, so please check this page periodically for changes. By using these Sites or ordering a Product after we post any changes to these terms, you agree to accept those changes, whether or not you have reviewed them or been notified about them. If at any time you choose not to accept these terms, please do not use this Site or any of our Sites.

Your privacy is important to us! Please review our privacy policy for information explaining the information we collect and how we use it.

Payments for Online Purchases

Payment for your coaching sessions and online purchases shall be made via credit card via Stripe. By placing an order with us, you agree that we may charge your account the full purchase price, including all fees and all applicable taxes, immediately or, if you have elected an optional payment plan, in accordance with the payment plan schedule provided at the point of purchase. All prices and other dollar amounts are listed in U.S. Dollars.

By placing an order with us, you represent and warrant that the credit card or payment account being used is yours, and/or that you are duly authorized to use the account, and you agree to indemnify and hold harmless TJT Coaching and each of its officers, directors, employees, contractors, coaches, representatives, agents, successors and assigns (each, a “Company Releasee” and collectively, the “Company Releasees”) from any and all damages or losses of any nature or kind, including attorneys’ fees, that any Company Releasee may incur arising from any breach of or inaccuracy in the foregoing representation and warranty.

Every effort has been made to ensure the accuracy of prices, items, and availability of Products available through our Sites; however, typographical, or clerical errors do occur. Accordingly, we reserve the right to revoke any stated price and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit or charge to your account in the amount of the charge. Images of Products on the Sites are for illustrative purposes only; actual Products may differ from such images.

We will email you to confirm the placement of your order and with details concerning product or service delivery. If there is an error in this email confirmation or with course emails (like it went to your spam folder), it is your responsibility to inform us as soon as possible. Truly, please let us know as soon as possible. We never want you to feel like you ordered something, and we did not deliver.

Cancellations and Refunds and Program Rules

It is our policy to provide all our clients with the best learning and coaching experience bar none. It is our experience that the following policies best reflect our commitment to our clients.

To support all coaching clients in realizing their objectives, all purchases of conferences, intensives, and retreats and assessments are final and non-refundable.

Intellectual Property: All materials in our programs are the intellectual property of TJT Coaching. You cannot share, copy, or create derivative works or resource guides that reference TJT Coaching, or Tracey Joan Thomas content, or infringe on the company’s intellectual property in any way. Company images, logos, and content are protected by trademark. You are granted no right or license to our trademarks.

Non-disparagement: You agree that you will not engage in any conduct or communications with a 3rd party, public or private, designed to disparage the TJT Coaching, Tracey Joan Thomas, including, but not limited to, any remark, comment, message, information, declaration, campaign, communication or other statement of any kind being verbal, in writing, electronic or otherwise that might be construed as derogatory, defamatory, libelous, or slander.

Finally, we reserve to the right to remove you from a program and withhold a refund, for any reason. For example: We may withhold a refund if you negatively impact someone else’s experience, share confidential material from this program produced by TJT Coaching or other students, promote yourself in our student Facebook group and try and convince other students to become your client, or participate in bad faith.

Overall Intellectual property

All content provided on the Site and in the Service, including all products and all online class and workshop materials are the intellectual property of TJT Coaching and are provided to our clients for their learning and not for commercial use. The content of the Site and Service are protected by United States trademark, trade dress and copyright law. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the content of the Site or the Service, in whole or in part without our prior written consent. You may not remove any trademark, copyright, or other notice from the content of the Site or the Service. We reserve the right to immediately remove you from the Service, without refund, at to pursue all available legal remedies against you if you are caught violating this intellectual property policy. Please don’t steal any of our content and reposition it to sell as your own.

OUR ANTI-DISCRIMINATION POLICY

This is a safe space for all people, We will not stand for discrimination or harassment of any kind from our clients or members of our team.

Definition of Discrimination: Discrimination based on race, creed, religion, color, age, disability, marital status, or any other status protected by law.

Definition of Harassment: Any behavior in the work environment that is unwanted or offensive to the recipient, which creates a hostile, humiliating, or intimidating work environment.
